Supreme Court orders PEMRA to grant broadcasting licence to GEO Super
The Supreme Court on Monday directed the Pakistan Electronic Regulatory Authority (PEMRA) to grant broadcasting license to GEO Super of Independent Music Group (IGM) and submit an implementation report within three days.
The three-member bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Tariq Parvez and Justice Amir Hani Muslim took up an appeal of the IMG regarding implementation of the Sindh High Court order.
During proceedings, Muhammad Akram Sheikh, counsel for IGM, said that the SHC had accepted their stance in its decision but the PEMRA was not implementing it.
He said their plea seeking grant of license had been pending since June 9, 2007 and according to rules, the Authority had to decide an application within 100 days.
The Chief Justice asked PEMRA Chairman Abdul Jabbar as to how other channels were airing their transmission while depriving a sports channel about its rights by placing objection of security reasons?
Justice Tariq Parvez observed that news channels were not posing any security risk but a sports channel telecasting hockey and cricket events had been considered as a security risk.
Ali Raza Kazim, counsel for PEMRA, said that GEO Super was already telecasting its transmission in Abu Dubai and another license in Pakistan could not be issued.
He said that they were not violating the Sindh High Court decision.In absence of permanent chairman such an order could not be passed, he added.
The Chief Justice told him to immediately issue license and told him if they had any issue, they could serve them with a show cause notice but without delaying implementation of the High Court decision. He said that the PEMRA had not filed an appeal in the Sindh High Court and accepted its decision.
He said that the PEMRA was not taking the High Court’s verdict seriously for which the officers concerned could be served with contempt notices.
He observed that in such cases compensation could be given to the aggrieved parties and cited a case of collapsed Margalla Towers.
On May 18, the SHC bench comprising Justice Gulzar Ahmad and Justice Shahid Anwar Bajwa had set aside the Ministry of Interior’s letter in which it had refused security clearance.
The Court had also set aside PEMRA’s letter in which it had rejected the license application of Geo Super.
However, the Court while setting aside the Authority’s refusal to grant license to Geo Super on grounds of security, did not direct the Authority to immediately issue a license to Geo Super.
